KIOGA Members: Greetings! KIOGA has been very busy addressing the lesser prairie chicken concern over the past couple of years and have kept membership abreast through our newsletters, KIOGA Express email blasts, KIOGA Federal & State Legislative Reports, KIOGA President Reports, KIOGA Website, and more. We just recently discussed the listing decision at our April 17th KIOGA Board Meeting. We now have more information to help membership. The U.S. Fish & Wildlife Service (USFWS) announced on March 27th that it is listing the lesser prairie chicken (LPC) as threatened. KIOGA and many other oil and gas groups have worked this issue hard over the last couple of years. We continue to work the issue as KIOGA is a partner with the Domestic Energy Producers Alliance (DEPA) and have filed suit against the USFWS citing the agency’s “sue and settle” tactics to regulate behind closed doors. In the meantime, many oil and gas operators possibly affected by the listing of the LPC want to know what options are available to avoid violating the Endangered Species Act. KIOGA members John G. Pike and Joseph A. Schremmer of the law firm Withers, Gough, Pike, Pfaff & Peterson, LLC in Wichita have developed a memo to explain the implications of the listing of the LPC as a threatened species under the Endangered Species Act and set forth the options for Kansas oil and gas operators to avoid violating the Endangered Species Act. The memo is attached. Also attached, is a copy of the Western Association of Fish & Wildlife Agencies (WAFWA) Oil and Gas Candidate Conservation Agreement with Assurances (CCAA) referenced in the memo. The purpose for the information attached is to provide information to assist oil and gas operators in making a decision on whether to enroll in a conservation plan.
